Samsung Elec, Hynix face SSD patent litigation in U.S.

South Korean chipmakers Samsung Electronics and SK Hynix along with a handful of IT companies in foreign and U.S. names face probe by the U.S. International Trade Commission (ITC) on charges of infringing on patents related to the solid state drive (SSD) technologies of U.S. chipmaker BitMICRO Inc.

According to the industry on Monday, BiTMICRO brought patent litigation based on the Section 337 of the U.S. Tariff Act against Korean companies Samsung Electronics and SK Hynix and PC server makers like Dell, Lenovo, HP, Asus and VAIO with the ITC.

Under Section 337 of the U.S. Tariff Act, U.S. ITC can impose sanctions on imports of products that have been found violating patents owned by domestic U.S. companies or individuals. Its decision whether to open probe into suspicious entities usually comes out within 30 days.

The move is suspected to be targeting mainly the Korean chipmakers that dominate the SSD market.

Samsung Electronics accounts for 30 percent of SSD supplies and SK Hynix the seventh largest. Flash-backed SSD is a non-volatile memory storage that is quickly replacing hard disk drive (HDD) in computers.
