Investigators at the Financial Service Commission (FSC) have seized mobile phones and documents of some employees at Hanmi Pharmaceutical Co. on Tuesday, on suspicion that the insider information on the termination of an exclusive agreement with Boehringer Ingelheim had been leaked via mobile messengers like Kakaotalk.

The drug maker has been under an extensive probe for holding back news about the deal breakdown intentionally. Suspicions are rising whether some investors have profited big through insider trading as there was a sudden spike in Hanmi shares short sold right before the announcement of the Boehringer fallout that caused Hanmi shares to plunge 18.1 percent on the main Kospi market on September 30. The stock ended Thursday 1.4 percent lower at 450,000 won, sinking from 620,000 won on September 29.

Kim Yong-beom, senior official from the FSC on Wednesday said that the commission’s capital market investigation team conducted an on-site inspection at the headquarters of Hanmi on Tuesday and secured documents and mobile phones of related officials after interrogation.

The mobile message reportedly saying “Don’t buy Hanmi stocks. Bad news will come out tomorrow” was sent at 6:36 p.m. on September 29, 30 minutes earlier than 7:06 p.m., the time Hanmi argued it was notified by Boerhinger on the deal termination.

The financial authority is considering referring the case directly to the prosecution after analyzing evidence. If the allegations proved, Hanmi would face a heavy penalty according to the nation’s capital market law.
