S Korean court asks gov’t and state lenders to help out Hanjin Shipping

The South Korean bankruptcy court administering Hanjin Shipping asked the government and creditors to come up with emergency actions to ease the cargo havoc in the aftermath of Hanjin’s insolvency.

A bankruptcy court at the Seoul Central District Court said on Wednesday that it issued an official request to the troubled shipper’s main creditor bank Korea Development Bank (KDB), asking for quick debtor-in-possession financing. It said the 100 billion won ($91.5 million) that the parent Hanjin Group pledged to inject into the shipper cannot resolve the company’s troubles and warned that Hanjin Shipping could become beyond rescue from further delay in immediate funding.

The court also sent government offices including finance ministry, the Financial Supervisory Commission (FSC), and oceans ministry separate requests, pleading government interference to persuade state lenders to help out the company.

Both the FSC and KDB have rejected the court request.

“There must be no misunderstanding about the logistics disruption after Hanjin Shipping went under court receivership and the problem of normalizing the company as they are two different issues,” a FSC official said.

But the Seoul court argued that without additional funding plan, it cannot persuade a U.S. counterpart to grant court protection for Hanjin Shipping vessels and cargoes at U.S. ports. A New Jersey bankruptcy court on Tuesday issued a provisional injunction for Hanjin vessels calling at U.S. ports. It makes final decision on Friday.
