Samsung countersues Huawei for patent infringement

Samsung Electronics Co. filed a counter suit against Huawei Technologies Co. in China, accusing the Chinese rival of infringing on its six patents. The legal action from the world’s largest smartphone maker comes after the Chinese firm sued Samsung Electronics for unlicensed use of its patented smartphone technologies in May this year.

Chinese news media reported on Friday that the Korean tech giant filed a lawsuit with an intellectual property court in Beijing against Huawei and Hengtongda Department Store Co. for damage claim worth 161 million yuan ($24 million), of which 80.5 million yuan is charged against Huawei, the Beijing court disclosed on Thursday.

Samsung Electronics argued that Huawei, the world’s third largest smartphone maker after Samsung and Apple Inc., infringed its six patented technologies related to wireless communications, image data storage and digital camera. It also claimed that Hengtongda Department Store, the de facto exclusive distributor of Huawei products, inflicted damages on the company by selling Huawei’s products made by using infringed patents.

In May this year, Huawei accused its bigger rival Samsung of illegally using its 11 patents in relation to icon and widget display on 16 products including Samsung’s flagship Galaxy S7. Some experts in the market suggested that Huawei might have an ulterior motive to strike a cross-licensing deal with Samsung as it had done with Ericsson through the same way.

As Samsung took a counter action against Huawei, it is very unlikely that the two would settle the matter through negotiations. Samsung is expected to file a lawsuit against Huawei in the U.S. court as well.
