A South Korean non practicing entity (NPE) fund invested by the Korea Development Bank (KDB) and Industrial Bank of Korea (IBK) in last June will make its first investment of 12.3 million won ($83 million) in patent rights of H.265, the next-generation media technology developed by KT and researchers at a local institution, according to KDB and KT on Tuesday.

A NPE capitalizes on patents by licensing them or suing against any patent infringements using its patent rights. NPEs are often dubbed as patent trolls, but they have been diversifying their business model besides patent lawsuits. A NPE fund plays a role in offering financial support and preventing patent infringements through direct investment in patents held by companies, universities and research centers.

The KDB-IBK NPE fund will obtain around 100 patent rights after investing 12.3 billion won in H.265. With the latest investment, it expects to earn patent royalties from 100 companies around the world including Apple Inc. by joining a patent pool formed by the global patent licensing agency MPEG-LA.

Established in 1997, MPEG-LA is a firm dedicated to form and manage patent pools for technologies used in consumer electronics, telecommunications, multimedia areas, chemical, eCommerce, healthcare, biotechnology, manufacturing and transportation. With licensing rights, it collects royalties from users of a certain patent for the patent holder. With the latest investment, the H.265 patent holder is expected to earn up to 20 billion won in royalties.
