Vertragsstrafe nach § 18 Hessisches Vergabe- und Tariftreuegesetz: Für jeden schuldhaften Verstoß gegen eine sich aus der Verpflichtungserklärung zu Tariftreue und Mindestentgelt ergebenden Verpflichtung hat der Auftragnehmer eine Vertragsstrafe in Höhe von einem Prozent der Nettoauftragssumme zu zahlen. Die Vertragsstrafe wird insgesamt auf 5 % der Nettoauftragssumme begrenzt.

Ergeht eine Mitteilung des Auftraggebers, der Rüge nicht abhelfen zu wollen, kann der Bewerber/Bieter wegen Nichtbeachtung der Vergabevorschriften ein Nachprüfungsverfahren nur innerhalb von 15 Kalendertagen nach Eingang vor der Vergabekammer beantragen.
